In the event of publication in another language, the German-language privacy policy remains authoritative. <\/p>\n\n<p>For individual or additional activities and operations, we may publish further privacy policies or other information on data protection.<\/p>\n\n<p>We are subject to Swiss law and, where applicable, foreign law, in particular that of the European Union (EU) with the European General Data Protection Regulation (GDPR).<\/p>\n\n<p>In its <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/TXT\/?uri=CELEX:32000D0518\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">decision of July 26, 2000<\/a>, the European Commission recognized that Swiss data protection law ensures adequate data protection. In its <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/de\/ip_24_161\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">report of January 15, 2024<\/a>, the European Commission confirmed this adequacy decision. <\/p>\n\n<h2 id=\"kontaktadressen\">1. Terms and Legal Bases<\/h2>\n\n<h3 id=\"begriffe\">2.1 Terms<\/h3>\n\n<p><strong>Data subject:<\/strong> A natural person about whom we process personal data.<\/p>\n\n<p><strong>Personal data:<\/strong> <em>Any<\/em> information relating to an identified or identifiable natural person.<\/p>\n\n<p><strong>Sensitive personal data:<\/strong> Data concerning trade union, political, religious, or philosophical views and activities; data concerning health, the intimate sphere, or affiliation with an ethnicity or race; genetic data; biometric data that uniquely identifies a natural person; data concerning criminal and administrative sanctions or proceedings; and data concerning social assistance measures.<\/p>\n\n<p><strong>Processing:<\/strong> <em>Any<\/em> handling of personal data, <em>regardless<\/em> of the means and procedures used, such as querying, matching, adapting, archiving, storing, reading, disclosing, procuring, recording, collecting, deleting, disclosing, sorting, organizing, saving, modifying, distributing, linking, destroying, and using personal data.<\/p>\n\n<p><strong>European Economic Area (EEA):<\/strong> <a href=\"https:\/\/de.wikipedia.org\/wiki\/Mitgliedstaaten_der_Europ\u00e4ischen_Union\" rel=\"nofollow noopener\" target=\"_blank\">Member states of the European Union<\/a> (EU) as well as the Principality of Liechtenstein, Iceland, and Norway.<\/p>\n\n<h3 id=\"rechtsgrundlagen\">2.2 Legal Bases<\/h3>\n\n<p>We process personal data in accordance with Swiss law, in particular the <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/oc\/2022\/491\/de\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" metadata=\"209871-1788868263\">Federal Act on Data Protection<\/a> (Data Protection Act, FDPIC) and the <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/oc\/2022\/568\/de\" rel=\"nofollow noopener\" target=\"_blank\">Data Protection Ordinance<\/a> (DPO).<\/p>\n\n<p><span id=\"rechtsgrundlagen-dsgvo\">We process personal data\u2014if and to the extent that the European General Data Protection Regulation (GDPR) is applicable\u2014in accordance with <em>at least<\/em> one of the following legal bases:<\/span><\/p>\n\n<ul>\n<li><a href=\"https:\/\/www.datenschutzpartner.ch\/dsgvo\/dsgvo-6\/#1b\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Art. 6 para. 1 lit. b GDPR<\/a> for the necessary processing of personal data for the performance of a contract with the data subject and for the implementation of pre-contractual measures.<\/li>\n<li><a href=\"https:\/\/www.datenschutzpartner.ch\/dsgvo\/dsgvo-6\/#1f\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Art. 6 para. 1 lit. f GDPR<\/a> for the necessary processing of personal data to protect legitimate interests\u2014including the legitimate interests of third parties\u2014unless the fundamental freedoms and rights as well as the interests of the data subject prevail. Such interests include, in particular, the permanent, humane, secure, and reliable exercise of our activities and operations, ensuring information security, protection against misuse, enforcement of our own legal claims, and compliance with Swiss law. <\/li>\n<li><a href=\"https:\/\/www.datenschutzpartner.ch\/dsgvo\/dsgvo-6\/#1c\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Art. 6 para. 1 lit. c GDPR<\/a> for the necessary processing of personal data to fulfill a legal obligation to which we are subject under any applicable law of member states in the European Economic Area (EEA).<\/li>\n<li><a href=\"https:\/\/www.datenschutzpartner.ch\/dsgvo\/dsgvo-6\/#1e\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Art. 6 para. 1 lit. e GDPR<\/a> for the necessary processing of personal data for the performance of a task carried out in the public interest.<\/li>\n<li><a href=\"https:\/\/www.datenschutzpartner.ch\/dsgvo\/dsgvo-6\/#1a\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Art. 6 para. 1 lit. a GDPR<\/a> for the processing of personal data with the consent of the data subject.<\/li>\n<li><a href=\"https:\/\/www.datenschutzpartner.ch\/dsgvo\/dsgvo-6\/#1d\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Art. 6 para. 1 lit. d GDPR<\/a> for the necessary processing of personal data to protect the vital interests of the data subject or another natural person.<\/li>\n<li><a href=\"https:\/\/www.datenschutzpartner.ch\/dsgvo\/dsgvo-9\/#2\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Art. 9 para. 2 et seq. GDPR<\/a> for the processing of special categories of personal data, in particular with the consent of the data subjects.<\/li>\n<\/ul>\n\n<p>The European General Data Protection Regulation (GDPR) refers to the processing of personal data as the processing of personal data and the processing of sensitive personal data as the processing of special categories of personal data <a href=\"https:\/\/www.datenschutzpartner.ch\/dsgvo\/dsgvo-9\/\" rel=\"nofollow noopener\" target=\"_blank\">(Art. 9 GDPR)<\/a>.<\/p>\n\n<h2 id=\"art-umfang-zweck\">3. Nature, Scope, and Purpose of the Processing of Personal Data<\/h2>\n\n<p>We process those personal data that are <em>necessary<\/em> to be able to carry out our activities and operations permanently, humanely, securely, and reliably. The processed personal data may fall in particular into the categories of browser and device data, content data, communication data, metadata, usage data, master data including inventory and contact data, location data, transaction data, contract data, and payment data. Furthermore, the personal data may constitute sensitive personal data.  <\/p>\n\n<p>We also process personal data that we receive from third parties, obtain from publicly accessible sources, or collect in the exercise of our activities and operations, provided that such processing is permissible.<\/p>\n\n<p>We process personal data, as far as necessary, with the consent of the data subjects. In many cases, we can process personal data without consent, for example to fulfill legal obligations or to protect overriding interests. We may also request consent from data subjects even if their consent is not required.  <\/p>\n\n<p>We process personal data for the <em>duration<\/em> required for the respective purpose. We anonymize or delete personal data in particular depending on statutory retention and limitation periods. <\/p>\n\n<h2 id=\"bekanntgabe\">4. Disclosure of Personal Data<\/h2>\n\n<p>We may <em>disclose personal data to third parties<\/em>, have it processed by third parties, or process it jointly with third parties. Such third parties may, for example, be specialized providers whose services we use. Such third parties may in turn disclose personal data to third parties.  <\/p>\n\n<p>Within the scope of our activities and operations, we may disclose personal data in particular to banks and other financial service providers, authorities, educational and research institutions, consultants and lawyers, accounting and fiduciary service providers, debt collection companies, interest groups, IT service providers, cooperation partners, credit and business information agencies, logistics and shipping companies, marketing and advertising agencies, media, parent, sister, and subsidiary companies, organizations and associations, social institutions, telecommunications companies, insurance companies, and payment service providers.<\/p>\n\n<h2 id=\"kommunikation\">5. Communication<\/h2>\n\n<p>We process personal data in order to be able to communicate with individuals as well as with authorities, organizations, and companies. In doing so, we process in particular data that a data subject transmits to us when contacting us, for example by post or email. We may store such data in an address book or using comparable tools.  <\/p>\n\n<p>Third parties who transmit data to us about other persons are legally obliged to independently ensure the data protection of these data subjects. In particular, they must ensure that they are permitted to transmit such data and also guarantee the accuracy of the transmitted data. <\/p>\n\n<p>We use selected services from suitable providers to enable and improve communication with individual persons and other communication partners. Using such services, we can also manage and otherwise process the data of data subjects beyond direct communication, for example in connection with orders, services, projects, and resource planning. <\/p>\n\n<h2 id=\"bewerbungen\">6. Applications<\/h2>\n\n<p>We process personal data about applicants to the extent necessary to assess their suitability for an employment relationship or for the subsequent execution of an employment contract. The required personal data result in particular from the information requested, for example in the context of a job advertisement. We may publish job advertisements with the help of suitable third parties, for example in electronic and printed media or on job portals and job platforms.  <\/p>\n\n<p>We also process personal data that applicants <em>voluntarily<\/em> provide or publish, in particular as part of cover letters, CVs, and other application documents, as well as part of online profiles.<\/p>\n\n<p><span id=\"bewerbungen-dsgvo\">We process\u2014if and to the extent that the General Data Protection Regulation (GDPR) is applicable\u2014personal data about applicants in particular according to <a href=\"https:\/\/www.datenschutzpartner.ch\/dsgvo\/dsgvo-9\/#2b\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Art. 9 para. 2 lit. b GDPR<\/a>.<\/span><\/p>\n\n<h2 id=\"sicherheit\">7. Data Security<\/h2>\n\n<p>We take appropriate technical and organizational measures to ensure data security appropriate to the respective risk. With our measures, we ensure in particular the confidentiality, availability, traceability, and integrity of the processed personal data, although we cannot guarantee absolute data security. <\/p>\n\n<p>Access to our website and our other digital presence is via transport encryption (<a href=\"https:\/\/de.wikipedia.org\/wiki\/Transport_Layer_Security\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">SSL \/ TLS<\/a>, in particular with the <a href=\"https:\/\/de.wikipedia.org\/wiki\/Hypertext_Transfer_Protocol_Secure\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Hypertext Transfer Protocol Secure, abbreviated HTTPS<\/a>). Most browsers warn against visiting a website without transport encryption. <\/p>\n\n<p>Our digital communication\u2014like <em>fundamentally<\/em> all digital communication\u2014is subject to mass surveillance without cause or suspicion by security authorities in Switzerland, the rest of Europe, the United States of America (USA), and other countries. We cannot exert any direct influence on the corresponding processing of personal data by intelligence services, police stations, and other security authorities. We also cannot rule out that a data subject is specifically monitored.  <\/p>\n\n<h2 id=\"ausland\">8. Personal Data Abroad<\/h2>\n\n<p>We <em>generally<\/em> process personal data in Switzerland and the European Economic Area (EEA). However, we may also export or transfer personal data to other states, in particular to process it there or have it processed there. <\/p>\n\n<p>We may export personal data to all <a href=\"https:\/\/de.wikipedia.org\/wiki\/Liste_der_Staaten_der_Erde#Liste\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">countries on Earth<\/a> and elsewhere in the <a href=\"https:\/\/www.datenschutzpartner.ch\/2022\/04\/23\/datenschutzerklaerung-daten-export-universum-mond\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">universe<\/a>, provided that the law there ensures adequate data protection in accordance with the <a href=\"https:\/\/www.fedlex.admin.ch\/eli\/cc\/2022\/568\/de#annex_1\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">decision of the Swiss Federal Council<\/a> and\u2014if and to the extent that the General Data Protection Regulation (GDPR) is applicable\u2014also in accordance with the <a href=\"https:\/\/commission.europa.eu\/law\/law-topic\/data-protection\/international-dimension-data-protection\/adequacy-decisions\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">decision of the European Commission<\/a>.<\/p>\n\n<p>We may transfer personal data to states whose law does not ensure adequate data protection, provided that data protection is guaranteed for other reasons, in particular on the basis of standard data protection clauses or with other appropriate guarantees. Exceptionally, we may export personal data to states without adequate or appropriate data protection if the special data protection requirements are met, for example the express consent of the data subjects or a direct connection with the conclusion or execution of a contract. We are happy to provide information to data subjects upon request about any guarantees or provide a copy of any guarantees.  <\/p>\n\n<h2 id=\"rechte\">9. Rights of Data Subjects<\/h2>\n\n<h3 id=\"ansprueche\">9.1 Data Protection Claims<\/h3>\n\n<p>We grant data subjects all claims in accordance with applicable law. Data subjects have the following rights in particular: <\/p>\n\n<ul>\n<li><strong>Information:<\/strong> Data subjects can request information as to whether we process personal data about them and, if so, which personal data it is. Data subjects also receive the information required to assert their data protection claims and ensure transparency. This includes the processed personal data as such, but also, among other things, information on the purpose of processing, the duration of storage, any disclosure or export of data to other states, and the origin of the personal data.  <\/li>\n<li><strong>Correction and restriction:<\/strong> Data subjects can correct incorrect personal data, complete incomplete data, and have the processing of their data restricted.<\/li>\n<li><strong>Opportunity for own standpoint and human review:<\/strong> Data subjects can state their own standpoint and request a review by a human being in the case of decisions based exclusively on automated processing of personal data that have legal consequences for them or significantly affect them (automated individual decisions).<\/li>\n<li><strong>Deletion and objection:<\/strong> Data subjects can have personal data deleted ('right to be forgotten') and object to the processing of their data with effect for the future.<\/li>\n<li><strong>Data release and data transfer:<\/strong> Data subjects can request the release of personal data or the transfer of their data to another controller.<\/li>\n<\/ul>\n\n<p>We may postpone, restrict, or refuse the exercise of the rights of data subjects within the legally permissible framework. We can point out to data subjects any requirements that may have to be met for the exercise of their data protection claims. For example, we may refuse information in whole or in part with reference to confidentiality obligations, overriding interests, or the protection of other persons. For example, we may also refuse the deletion of personal data in whole or in part, in particular with reference to statutory retention obligations.   <\/p>\n\n<p>We may <em>exceptionally<\/em> provide for costs for the exercise of rights. We inform data subjects in advance about any costs. <\/p>\n\n<p>We are obliged to identify data subjects who request information or assert other rights using appropriate measures. Data subjects are obliged to cooperate. <\/p>\n\n<h3 id=\"rechtsschutz\">9.2 Legal Protection<\/h3>\n\n<p>Data subjects have the right to enforce their data protection claims through legal action or to file a report or complaint with a data protection supervisory authority.<\/p>\n\n<p>The data protection supervisory authority for private controllers and federal bodies in Switzerland is the <a href=\"https:\/\/www.edoeb.admin.ch\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\" metadata=\"209871-1788868263\">Federal Data Protection and Information Commissioner (FDPIC)<\/a>.<\/p>\n\n<p>European data protection supervisory authorities are organized as <a href=\"https:\/\/www.edpb.europa.eu\/about-edpb\/about-edpb\/members\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">members of the European Data Protection Board<\/a> (EDPB). In some member states in the European Economic Area (EEA), the data protection supervisory authorities have a federal structure, <a href=\"https:\/\/www.bfdi.bund.de\/DE\/Service\/Anschriften\/Laender\/Laender-node.html\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">in particular in Germany<\/a>. <\/p>\n\n<h2 id=\"website\">10. Use of the Website<\/h2>\n\n<h3 id=\"cookies\">10.1 Cookies<\/h3>\n\n<p>We may use cookies. Cookies\u2014both our own cookies (first-party cookies) and cookies from third parties whose services we use (third-party cookies)\u2014are data stored in the browser. Such stored data need not be limited to traditional cookies in text form.  <\/p>\n\n<p>Cookies can be stored in the browser temporarily as 'session cookies' or for a certain period as so-called permanent cookies. The information is necessary to be able to provide our digital presence permanently, humanely, and reliably. The information is also necessary to be able to ensure data security\u2014also by third parties or with the help of third parties.  <\/p>\n\n<h3 id=\"zaehlpixel\">10.3 Tracking Pixels<\/h3>\n\n<p>We may integrate tracking pixels into our digital presence. Tracking pixels are also known as web beacons. Tracking pixels\u2014also from third parties whose services we use\u2014are usually small, invisible images or scripts formulated in JavaScript that are automatically retrieved when accessing our digital presence. In the case of such embedding, the services used record the <a href=\"https:\/\/de.wikipedia.org\/wiki\/IP-Adresse\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">IP addresses<\/a> of the users at least temporarily for technically compelling reasons.  <\/p>\n\n<p>For necessary security-related, statistical, and technical purposes, third parties whose services we use may process data in connection with our activities and operations in aggregated, anonymized, or pseudonymized form.
